(Hereinafter referred to as the Company)
CONDITIONS OF BUSINESS APPLYING TO PARTS SALES
1) The Customer shall pay for all parts on collection from the Company unless a credit account with the Company has been approved and such payment shall be in a form acceptable to the Company.

2) Where payment is not made on collection, by agreement with the Company, payment shall be made in accordance with the terms stipulated by the Company and the Company shall be entitled to charge interest on all overdue amounts at the rate of 8% above the base rate of the Bank of England from time to time until full payment is made. The Company will rely on the Late Payment of Commercial Debts (Interest) Act 1998 to claim compensation for any late payments.

3) Each part supplied will remain the legal and beneficial property of the Company until full payment of all amounts owing to the Company by the Customer has been made. Until such time as property in each part passes to the Customer the Company shall be entitled at any time to require the Customer to deliver up each part and if the Customer fails to do so forthwith to enter upon any premises of the Customer or any third party where each part is stored to repossess it or them.

4) As a result of periodic disruption in supply the Company does not guarantee that the parts to be supplied will originate from the vehicle manufacturer.

5) Where the Company has to order parts specially to fulfil the order a deposit is required from the Customer in an amount to be specified by the Company. If the customer does not have a credit account full payment is required before parts will be ordered.

6) Any queries or returns must be made within 14 days and the return must be supported by the relevant documentation. Goods must be in acceptable condition fit for resale.

7) A 15% handling charge will be made on parts returned for credit except for items returned under the exchange scheme.

8) Exchange reconditioned parts will be subjected to a surcharge until such time as the displaced parts are handed in and the Customer shall ensure that this shall not exceed 7 days.

9) Parts ordered on a VOR basis are subject to an additional surcharge and cannot be returned for credit.

10) The Company will endeavour to pass the Customer the benefit of any guarantee or warranty given by the manufacturer of the parts. Genuine JCB parts purchased from the company carry a 6 month warranty against defect.

11) Save as expressly provided in these conditions the Company shall not be liable to the Customer for any losses of whatever nature and all warranties conditions or other terms implied by statute or common law as to the quality of the parts or their fitness for purpose are hereby excluded to the fullest extent permitted by law.

Where the parts are sold under a consumer sale the statutory rights of the Customer are not affected by these conditions.


CONDITIONS OF BUSINESS APPLYING TO SERVICES AND REPAIRS
1) Every reasonable effort will be made to complete the service or repair in a reasonable time but the Company shall be under no liability to the Customer whatsoever for any loss of whatever nature occasioned by delay in performance arising out of any cause whatsoever.

2) The Customer will collect the Vehicle from the Company’s premises within 7 days of notification that the vehicle is ready for collection failing which a daily storage charge may be levied.

3) The Customer shall pay for the service or repair on collection of the Vehicle unless a credit account with the Company has been approved and such payment shall be in a form acceptable to the Company. Whilst in its possession the Company shall have a lien over the vehicle as security for its charges.

7) Save as expressly provided in these conditions the Company shall not be liable to the Customer for any losses of whatever nature and all warranties conditions or other terms implied by statute or common law as to be standard of performance are hereby excluded to the fullest extent permitted by law.

8) The Customer should remove all valuables from the Vehicle before leaving it for service or repair as the Company shall have no liability to the Customer in respect of loss of or damage to valuables.

9) No queries will be accepted unless notified within 21 days from the date of invoice.

10) Genuine JCB parts fitted by the company carry a 12 month warranty against defect.

Where the customer deals as a consumer, the statutory rights of the Customer are not affected by these conditions
